“Bicycle rental”  and general terms of the lease agreement

(Hereandaftere referred as to „Regualtions”)

 

1 GENERAL TERMS

These Regulations define the rules for the organization and operation of bicycle rental (hereinafter referred to as “Rental”) run by Mr. Paweł Poręba operating under the business name Paweł Poręba Beskid Trip, NIP: 737-207-34-53 (hereinafter referred to as the “Organizer”).

The organizer indicates that the rental company rents classic bicycles and electric bicycles as part of its activity.

 

2 RULES OF FUNCTIONING OF THE RENTAL

The rental is available from 10:00 to 18:00 (also on Saturdays and holidays).

The rental company operates in Cracow. Points where it will be possible to rent a bike are:

Wiślna 4,

The rental company, as a part of the activity conducted by the Organizer, rents the following bicycles for the fee specified in the price list (§3, sections 2 and 3 of the Regulations):

Geobike x-road 2 electric bicycles, which total amount available for rent is 10;

Merida classic bikes, which total amount available for rent is 11.

Bikes offered by the Organizer within the framework of the rental can be rented only to the person who:

Holds two documents confirming his identity;

Accepts these Regulations;

Will sign a bike rental agreement;

Will pay a refundable deposit of PLN 50, which will be retained for the duration of the lease.

The rental fee is charged in advance, according to the period of rental specified by the customer.

The condition for renting a bike is paying the refundable deposit by the Customer in the amount of PLN 50 (in words: fifty zlotys), retained by the Rental at the time of renting a bike.

 

When the bike is returned to the rental at the indicated time, the deposit will be released. However, if the customer fails to return the bike on time, the amount due for the delay is deducted from the retained bail.

The fact of the rental and return of the bike and its technical condition, as well as the fact of reading the Regulations and the obligation to comply with the Regulations of the Rental by the Customer, is confirmed each time in the bicycle rental agreement.

Bicycle rental agreement is a document confirming the conclusion of the contract, as well as reading and acceptance of these Regulations.

Bicycles are each time rented and returned at the available stations of the Rental, indicated in § 2 point 2.

By renting a bicycle, the Customer assumes full responsibility for damages incurred during its use from the moment of signing the contract to the moment of returning the bike. In the event of damage or theft of the bike, the Customer is obliged to cover all damages incurred by the Rental in the full amount.

In the event of the theft of the bike, the Customer is obliged to report this fact to the Police and present a report in the Rental confirming the registration. This does not relieve the Customer from material liability for the damage suffered and the need to return an amount equal to the value of the bike less the bail.

The Rental does not bear any responsibility for any events or damages caused during the use of bikes by the Customer. The customer waives all claims against the Rental for unfortunate events, damages or injuries arising from the use of rented bikes.

The Rental shall provide the Customer with technically sound equipment, equipped in accordance with the applicable safety regulations, and the confirmation of this fact shall be the Customer’s signature on the rental card.

The bicycle should be returned to the Rental Room on the date specified in the bicycle rental agreement. If the Client wants to extend the rental period, he/she should inform the Rental before the expiry of the rental date, by phone at 535514917 or by email to: lifesportpl@gmail.com. Submission of the intention to extend the lease should take place during the rental office hours (§2 item 1 of the Regulations), no later than one hour from the original end date of the rental.

In case of violation of the rules referred to in para. 15 above, the retained deposit is not returnable and the client’s action will be treated as an affranchisement of property and will be reported to the law enforcement authorities.

The rental company has the right to refuse to rent a bike without justification.

The use of rented equipment can take up to 30 km within Krakow.

The client making the lease for a period of 24 hours, which requires the bicycle to be stored overnight, is obliged to secure the property at his own expense.

 

3 CHARGES

The Rental provides rental bikes with the following unit value:

Geobike electric bicycle with a unit value of PLN 5,400 gross (in words: five thousand four hundred zlotys gross);

Merida bike with a unit value of PLN 2,200 gross (in words: two thousand two hundred zlotys gross).

The fee for renting an electric bike referred to in paragraph 1 point a) above is respectively:

In the case of a lease for less than one day, the Rental Office accepts an hourly rate and sets it for 1 hour – PLN 20;

In the case of a lease for one day, the Rental Office accepts a quantity rate and establishes it as follows:

Rental of one bicycle: 1 bike – 100 zlotys;

Rental of more than 1 bicycle: 1 bike – 90 zlotys;

In the case of a lease for a period of two days, the Rental accepts a quantity rate and determines it in the following way:

Rental of one bicycle: 1 bike – 180 zlotys;

Rental of more than one bicycle: 1 bike – PLN 160;

In the case of a lease for a period of three days, the Rental accepts a quantity rate and establishes it as follows:

Rental of one bicycle: 1 bike – PLN 260;

Rental of more than 1 bicycle: 1 bike – 250 PLN;

In the case of a lease for a period exceeding 3 days, the Rental accepts a mixed rate (both daily and quantitative) and sets it in the following way:

renting one bicycle: 1 bike – PLN 260 (for the first three days) increased by PLN 80 for each subsequent day of rental; renting more than 1 bicycle: 1 bike – 250 PLN (for the first 3 days) plus 70 PLN for each subsequent day of the lease.

The fee for renting a classical bicycle, referred to in paragraph 1 point b) above is respectively: 1 day

 

In the case of a lease for less than one day, the Rental accepts an hourly rate and sets it for one hour – PLN 10;

In the case of a lease for one day, the Rental accepts a quantity rate and establishes it as follows:

renting one bicycle: 1 bike – PLN 50;

renting more than 1 bicycle: 1 bike – PLN 45;

In the case of a lease for a period of two days, the Rental accepts a quantity rate and determines it in the following way:

renting one bicycle: 1 bike – PLN 90;

renting more than 1 bicycle: 1 bike – PLN85;

In the case of a lease for a period of three days, the Rental accepts a quantity rate and establishes it as follows:

renting one bicycle: 1 bike – PLN 130;

renting more than 1 bicycle: 1 bike – PLN 120;

In the case of a lease for a period exceeding 3 days, the Rental accepts a mixed rate (both daily and quantitative) and sets it in the following way:

renting one bicycle: 1 bike – PLN 130 (for the first 3 days) increased by PLN 45 for each subsequent day of the lease;

renting more than 1 bicycle: 1 bike – PLN 125 ( for the first 3 days) increased by PLN 40 for each subsequent day of the lease.

In case of not returning the bike to the Rental in the declared time, the Organizer will contact the Customer by phone. Each intervention phone to the customer costs PLN 10 (in words: ten zlotys). In the absence of contact, a security patrol will be launched to locate the equipment. If it is necessary to use the services of Solid Security patrol, a fine of 100 PLN (in words: one hundred zlotys) will be imposed on the Customer.

 

4 PERSONAL DATA

The administrator of the Customer Personal Data is Mr. Paweł Poręba running a business under the namePaweł Poręba Beskid Trip, Kobyłczyna 90, 34 – 600 Ujanowice, NIP: 737-207-34-53;

Personal data is processed for purposes resulting from the execution of the concluded agreement, to which you and the Administrator are parties, in particular the fulfillment of the terms of the agreement, e.g. the provision of services, customer service, billing, termination of the contract;

Personal data are processed on the basis of art. 6 par. 1 point b) of the Regulation of the European Parliament and of the Council 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (hereinafter “RODO”);

You have the right to access your personal data and correct them;

Providing personal data in the scope indicated in paragraph 2 above is voluntary, however, failure to provide them may result in the inability to conclude a contract or other agreement, which will consequently prevent the provision of the Parties;

The data will be processed in the time necessary to achieve their purpose, i.e. from the moment the contract is concluded until the contract terms expire, e.g. providing services, customer service, settlements, termination of the contract;

You have the right to access your data, rectify it, delete it, limit processing, object to its processing, the right to transfer the data, as well as the right to file a complaint to the supervisory authority;

Data recipients may be external companies servicing the Data Administrator in areas necessary for day-to-day operations, i.e. public law bodies, banks, entities providing accounting and billing services for the Administrator, entities providing legal services to the Administrator.

 

5 FINAL PROVISIONS

Acceptance of the Regulations of the Rental means the consent of the Customer to the conditions set out in these Regulations. The Regulations of the Rental will be available in the points of the Rental.

In case of any doubts regarding the rules of the Rental operation, the Organizer reserves the right to interpret the terms and conditions presented in these Regulations.

In matters not covered by these regulations, the relevant provisions of the Civil Code shall apply.

Any disputes arising from the performance of obligations related to this contract shall be settled by the court competent for the seat of the Organizer.
